Liquor Licensing

With over 38 years of experience in liquor licensing and liquor liability matters, our attorneys are versed in the most effective and timely methods to sell, buy and transfer a liquor license. We handle all matters related to your liquor license, from application and renewal, to purchases and sales of licenses, to defending your establishment against liability for harms arising from the sale of liquor.

The liquor industry is heavily regulated at both the state and federal levels, and it is common for an establishment serving or otherwise selling liquor to receive a citation from either the state police Bureau of Liquor Control Enforcement.   If you violate the terms of your liquor license and receive a citation, you could face severe penalties including the revocation of your liquor license. At a minimum, you will go before the Liquor Control Board for a mandatory administrative hearing to determine if you are in violation of your license. If your liquor license is revoked, you are ineligible to apply for another license for 3 years. This consequence can be fatal for a small business that depends on the sale of liquor to continue operating at a profit. You are entitled to have an attorney represent you at every stage in the citation and administrative hearing process, and an experienced liquor licensing attorney is imperative to safeguard your valuable license.

We have helped countless bars, restaurants, distributors and small and mid-size businesses defend against Dram Shop liability and other liquor liability charges. We currently represent over 200 different licensees in liquor licensing and liability matters such as:

  • Liquor license applications
  • Zoning and land use regulations for liquor sales
  • Negotiating the sale or purchase of licenses
  • Transfer or renewal of liquor licenses
  • Special liquor permits
  • Dram Shop liability
  • Liquor liability defense

DUI  Defense

The state of Pennsylvania has very strict DUI  laws, including observation of a “per se” DUI  law where you do not have to appear impaired so long as your blood alcohol concentration (BAC) exceeds .08%. The penalties you face for a DUI  conviction are potentially devastating.  First time offenders can expect to have their license suspended or revoked in addition to the imposition of a fine. On your second offense, you will be required to attend mandatory alcohol education, treatment, and assessment in addition to suspension of your driver’s license for up to 2 years as well as vehicle confiscation or the installation of an ignition interlock device on your car.

The attorneys at the Law Offices of McCreesh, McCreesh & Cannon have successfully defended numerous drivers against DUI  charges and helped them avoid the damaging consequences of a criminal conviction. We make a detailed investigation of the circumstances surrounding your initial vehicle stop to determine if there was probable cause for pulling your vehicle over, and examine whether the field sobriety test was administered in strict adherence with the law. As an example, if the breathalyzer was not properly stored or calibrated for accuracy, evidence of your blood alcohol content could be deemed inadmissible and the charges against may be dropped. Our DUI defense strategies often rest on finding holes in the police work and prosecution’s evidence in attempt to have the criminal charges against you reduced or altogether dropped. Our DUI / DWI defense services are always custom tailored to meet each client’s particular circumstances, whether this is their first offense or they are a repeat offender.
